This lesson opens the last unit, on questions that philosophy is asked to settle now. Earlier lessons supplied the tools: the theories of right action, the problem of other minds, and the question of how far our duties reach. Here they are put to work on a question most of us answer three times a day without noticing that we have been asked.

Do Animals Have Rights?

01The clock and the cry

For most of the history of Western philosophy the question had a short answer. Animals lack reason, and beings without reason are outside morality. Descartes gave the view its sharpest form in 1637. Animals do many things better than we do, he observed, and this shows only that “it is nature which acts in them according to the disposition of their organs,” as “a clock composed only of wheels and weights can number the hours and measure time more exactly than we.” An animal is a machine made by the hands of God. Some of his followers drew the conclusion that its cries under the knife were the noise of a mechanism.

Kant did not think animals were machines, and he condemned cruelty to them. His reason was indirect. A man who is cruel to animals becomes hard in his dealings with people, so we should treat animals kindly for the sake of humanity. On this view we have duties concerning animals and none to them. The dog has no claim of its own. It has the standing of a neighbor’s window, which we must not break because of what breaking it would do to the neighbor and to us.

02Bentham’s footnote

In 1789 Jeremy Bentham, in a footnote to a book on the principles of law, compared the treatment of animals to slavery. The French had already seen, he wrote, that the blackness of the skin is no reason for abandoning a human being to a tormentor. One day it may be recognized that the number of legs or the hairiness of the skin is no better reason. What else could mark the line? Reason, or speech? “But a full-grown horse or dog is beyond comparison a more rational, as well as a more conversable animal, than an infant of a day or a week or even a month, old. But suppose they were otherwise, what would it avail? The question is not, Can they reason? nor Can they talk? but, Can they suffer?”

The argument has two steps, and both have lasted. The first is that any property we might use to exclude animals, such as reason or language, is also missing in some human beings whom no one proposes to exclude. The second is that the capacity to suffer is what gives a being interests at all. A stone has no interests because nothing we do to it matters to it. A being that can suffer has at least an interest in not suffering, and Bentham saw no reason why the pain should count for less because of the shape of the body that feels it.

03Equal consideration

The footnote was little noticed for a long time. In 1975 Peter Singer made it the foundation of a book, Animal Liberation. His principle is the equal consideration of interests: like interests are to be given equal weight, whoever’s interests they are. To give less weight to an animal’s pain merely because it is not a member of our species is, he argued, a prejudice of the same form as racism, and he took up a new word for it, speciesism. The principle does not say that a pig and a child should be treated alike, since their interests differ. A pig has no interest in learning to read. It does have an interest in not being confined for life in a crate too narrow to turn around in. Most of the book is a description of what is done to animals in laboratories and on industrial farms, where today more than eighty billion land animals are killed each year.

Singer is a utilitarian, and strictly he does not speak of rights. For him animals count in the sum of well-being, and an experiment that caused some suffering and prevented far more could be justified, on an animal or on a human being. Tom Regan thought this conceded too much. In The Case for Animal Rights, in 1983, he argued in the manner of Kant that some beings are not to be used as means at all. The beings he had in mind are those he called subjects of a life: creatures with perception, memory, desires, and a welfare that matters to them. They have a value that is not a quantity to be added up, and it gives them a right not to be treated as resources. On Regan’s view the cages should be emptied. Making them larger is not enough.

The strongest reply comes from the idea of a contract. Rights, on this view, belong to members of a moral community, beings who can make claims on one another, recognize duties, and be held to account. A wolf cannot respect the rights of a deer, and we do not blame it. To have rights is to stand in relations that animals cannot enter. The philosopher Carl Cohen put the point by saying that animals are not the kind of being that can have rights, though we may still have duties of kindness toward them. Human infants are covered because they belong to a kind whose normal members are moral agents.

A second reply defends partiality. The lesson on strangers found that we owe more to those close to us, and that this is not obviously a prejudice. Mary Midgley argued that a preference for one’s own species is like the preference for one’s own family. It is a natural bond that gives a reason, and it leaves room for real duties to outsiders. The defenders of animals answer that a bond explains why we care more about some beings, and it cannot show that the suffering of the others counts for nothing.

05The kitchen at a distance

The Chinese tradition met the question early and gave an honest and uncomfortable answer. King Xuan of Qi, as an earlier lesson told, could not bear the fear of an ox being led to slaughter and ordered a sheep to be used in its place. Mencius approved of the feeling and drew a conclusion about the gentleman: having seen animals alive, he cannot bear to see them die, and having heard their cries, he cannot bear to eat their flesh. “That is why the gentleman keeps his distance from the kitchen.” The feeling is taken as the root of humaneness, and the practice goes on out of sight. Mencius held that love has degrees: affection for family, humaneness toward people, and a sparing care for creatures.

Buddhism went further and made not killing the first of its precepts, on a ground close to Bentham’s. “All tremble at the rod, all fear death. Treating others like oneself, neither kill nor incite to kill.” Chinese Buddhists, from the sixth century, drew the conclusion that monastics should not eat meat at all. Between Mencius’s kitchen and the monastery’s table lie most of the positions that people hold today. The philosophical question is whether the place where each of us has stopped rests on a reason, or only on what we have managed not to see.

Jeremy Bentham, An Introduction to the Principles of Morals and Legislation (1789), chapter 17, note; René Descartes, Discourse on the Method (1637), part 5 邊沁《道德與立法原理導論》第十七章註;笛卡兒《談談方法》第五部 · Bentham in the original English; Descartes translated by John Veitch (1850), public domain

The day has been, I grieve to say in many places it is not yet past, in which the greater part of the species, under the denomination of slaves, have been treated by the law exactly upon the same footing as, in England for example, the inferior races of animals are still. The day may come when the rest of the animal creation may acquire those rights which never could have been withholden from them but by the hand of tyranny. The French have already discovered that the blackness of the skin is no reason why a human being should be abandoned without redress to the caprice of a tormentor. It may one day come to be recognized that the number of legs, the villosity of the skin, or the termination of the os sacrum are reasons equally insufficient for abandoning a sensitive being to the same fate.

Bentham, Principles of Morals and Legislation, ch. 17, note

Bentham wrote “rights” here although he thought natural rights were nonsense. He meant legal rights, which a legislature could grant. The “termination of the os sacrum” is his dry way of saying a tail. The famous sentences about reasoning, talking, and suffering follow immediately and are quoted in the lesson above.

It is also very worthy of remark, that, though there are many animals which manifest more industry than we in certain of their actions, the same animals are yet observed to show none at all in many others: so that the circumstance that they do better than we does not prove that they are endowed with mind, for it would thence follow that they possessed greater reason than any of us, and could surpass us in all things; on the contrary, it rather proves that they are destitute of reason, and that it is nature which acts in them according to the disposition of their organs: thus it is seen, that a clock composed only of wheels and weights can number the hours and measure time more exactly than we with all our skill.

Descartes, Discourse on the Method, part 5

Descartes’s tests for mind were flexible language and flexible action, the same two tests later proposed for machines. Whether he himself denied that animals feel is disputed by scholars. In letters he allowed them sensation of a bodily kind. What is not disputed is the use that was made of the doctrine.

Objections and replies

Objection 1 · 反駁

Animals eat each other. If killing animals for food is wrong, nature is one vast crime.

Reply · 回應

The lion has no choice and no concept of choice, so it cannot do wrong, for the reason that the contract theorists gave. We are in a different position, since most people in rich countries can live well without meat. What other animals do is no guide to what we may do. No one cites the habits of lions to settle other moral questions.

Objection 2 · 反駁

If animals have rights, then a mouse counts as much as a child, and that is absurd.

Reply · 回應

Neither Singer nor Regan holds this. Equal consideration of interests is compatible with thinking that a child’s death is a greater loss, because a child has more to lose: plans, relationships, a future understood as her own. Regan says the same in the case of a lifeboat that cannot hold everyone. The claim is that the mouse’s suffering counts for something. It is not that all lives are worth the same.

Objection 3 · 反駁

Where does it stop? Plants respond to injury. If we cannot eat pigs, we cannot eat rice.

Reply · 回應

Responding to damage is not the same as feeling it. Plants have no nervous system, and nothing in their behavior requires us to suppose that there is something it is like to be one. The line between feeling and not feeling is hard to locate near insects and shellfish, and that is a reason for caution there. It is no reason to doubt the cases far from the line. A person who truly worried about plants would also eat fewer animals, since farm animals are fed many times their own weight in crops.

Dharma and the West ·

A view from the Dharma

The Buddha’s position is stated in a verse of the Dhammapada: “All tremble at the rod, all fear death. Treating others like oneself, neither kill nor incite to kill.” The ground is the one Bentham would give, with a different emphasis. Bentham counts pains. The verse asks the hearer to put himself in the other’s place. The class of beings covered is “all sentient beings,” and no line is drawn at the human. The teaching of rebirth adds a thought that has no Western parallel. In the long course of wandering, the Buddha says, “it’s not easy to find a sentient being who in all this long time has not previously been your mother.” An animal is a fellow traveler in another form. It is not a different kind of thing.

On what follows for the table, the tradition divides, and it is honest to say so. In the early discourses the Buddha did not require vegetarianism. He told the physician Jīvaka that a monk may not eat meat when he has seen, heard, or suspected that the animal was killed for him, and may eat it otherwise. The rule fixes on the eater’s part in the killing. The Mahāyāna scriptures that shaped Chinese Buddhism went further and held that eating meat cuts off the seed of great compassion, and Emperor Wu of Liang made abstention the rule for monasteries in the sixth century. Singer and Regan would recognize both positions. The first asks what I cause. The second asks what kind of person the practice makes of me, which is the question that virtue ethics asks (A18).
