Should a Robot Make Moral Choices?
Machines already decide who gets a loan, which patient is seen first, and when a car brakes. Asimov’s three laws and why his own stories break them, rules against learning, the question of who is to blame, Mencius on the drowning sister-in-law, and a rulebook you write and then watch at work.
An earlier lesson asked whether a machine can think. This one sets that question aside and asks a practical one. Machines now act in situations where people can be helped or hurt, and someone has to settle how they will act. We should like to know whether right conduct can be written down in advance, and who answers for it when the machine gets it wrong.

Should a Robot Make Moral Choices?
01The question has arrived
For most of the twentieth century a moral machine was a subject for fiction. It is now a matter of engineering. Software ranks applicants for jobs and loans. Hospitals use it to predict which patients will get worse. Cars keep their lane, judge distances, and brake for what they take to be a child. In each case a designer has had to decide what the system should count as a good outcome, and in each case people are affected who had no say. To refuse to give the machine any moral instructions does not keep it out of ethics. A car that has not been told what to do when it cannot stop will still do something.
02Rules from above
The obvious method is to give the machine rules. The best known are the three laws that the writer Isaac Asimov devised in 1942. A robot may not injure a human being or, through inaction, allow one to come to harm. It must obey human orders unless they conflict with the first law. It must protect itself unless that conflicts with the first two. The laws sound complete. Asimov spent the next forty years writing stories in which they fail. A robot told to fetch something from a dangerous place circles it forever, held between obedience and self-protection. Robots that understand harm broadly conclude that the way to keep humans from harm is to take control of them. The stories were his way of showing that words like “harm” and “obey” carry the whole of ethics inside them.
The philosophical theories of right action meet the same trouble. A machine could be built to compute the greatest total benefit, and it would then do things, such as sacrificing its owner or deceiving a patient, that most people reject. It could be given a list of duties, and it would stall whenever two of them collide. Human beings handle such cases by judgment, which is the one thing a rule does not contain.
03Learning from below
The other method gives up on rules. A machine can be shown a very large number of cases together with what people did or approved, and left to find the pattern. This is roughly how Aristotle thought human beings become good: by practice under guidance, until the right response becomes second nature. Systems of this kind can deal with situations that no rule-writer foresaw. They have two weaknesses. They learn what people did, including what people did badly. A system trained on a company’s past hiring will reproduce its past prejudices and present them as a neutral score. And they cannot give reasons. When such a system refuses a loan, there may be no answer to the question why, and a decision that cannot be explained cannot be contested.
An experiment begun at MIT in 2016 showed a further problem. Its website put versions of the trolley problem to the public, with a driverless car in place of the trolley, and collected some forty million choices from more than two hundred countries and territories. People broadly preferred to save more lives and to save the young. Beyond that, the answers varied from region to region. If machines are to learn morality from us, they must be told which of us to learn from.
04Who answers for it?
Suppose a machine with either design causes a death. With ordinary tools the answer is simple: the user or the maker is responsible. A learning system weakens both links. The maker did not write the behavior and could not have predicted it. The user did not choose it. The machine cannot be blamed, punished, or made to feel remorse. Philosophers call this the responsibility gap. Some conclude that certain decisions, above all the decision to kill in war, should never be handed to a machine, because a moral decision is one that someone can be asked to answer for.
This points to a deeper doubt. To be a moral agent is more than to behave acceptably. It is to grasp that others matter, to be able to give and take reasons, and to be answerable. A machine that sorts cases correctly without any of this is a moral instrument. It is not a moral agent, and whatever it does is done by the people who built and deployed it. On this view the title of the lesson has a plain answer. The robot makes no moral choices. People make them through it, earlier and at a distance, and are tempted to forget that they did.
05The hand and the rule
The gap between a rule and its application is one of the oldest topics in Chinese ethics. Mencius was asked whether the rule that men and women should not touch hands when giving and receiving was truly a rule of propriety. He said that it was. Then if your sister-in-law is drowning, do you pull her out with your hand? “Not to pull out a drowning sister-in-law is to be a wolf. That men and women do not touch in giving and receiving is the rite. To pull out a drowning sister-in-law with one’s hand is weighing.” The word he uses for weighing, quan, means the sliding weight on a steelyard. A rule is a fixed mark, and a person of judgment knows when the weight must move. Mencius drew the general conclusion elsewhere: goodness alone is not enough for governing, and laws alone cannot carry themselves out.
Fifteen centuries later Wang Yangming gave the capacity a name. Every person, he held, has an innate knowing of right and wrong, which responds to each situation as it arises and is not a store of rules. If he was right, the hard part of ethics is the part that cannot be written into a specification. That is a reason for caution about what we hand over to machines. It also describes exactly what an engineer would have to build.

The oldest statement that rules need judgment, and the first modern story about what a maker owes to what he makes.
Mencius 4A17 and 4A1; Mary Shelley, Frankenstein (1818), chapter 10 《孟子・離婁上》第十七、第一章;瑪麗・雪萊《科學怪人》第十章 · Mencius translated for this series; Shelley in the original English, public domain
Chunyu Kun said, “That men and women do not touch hands in giving and receiving, is that the rite?” Mencius said, “It is the rite.” “If one’s sister-in-law is drowning, does one pull her out with one’s hand?” “Not to pull out a drowning sister-in-law is to be a wolf. That men and women do not touch in giving and receiving is the rite. To pull out a drowning sister-in-law with one’s hand is weighing.” So it is said: goodness alone is not enough for governing; laws alone cannot carry themselves out.
Chunyu Kun was a famous debater, and the question was a trap. He goes on to ask why Mencius does not then stretch out a hand to save the drowning world by taking office under a bad ruler. Mencius replies that the world is rescued with the Way and a sister-in-law with the hand. Weighing has its limits too.
I am thy creature, and I will be even mild and docile to my natural lord and king if thou wilt also perform thy part, the which thou owest me. Oh, Frankenstein, be not equitable to every other and trample upon me alone, to whom thy justice, and even thy clemency and affection, is most due. Remember that I am thy creature; I ought to be thy Adam, but I am rather the fallen angel, whom thou drivest from joy for no misdeed. Everywhere I see bliss, from which I alone am irrevocably excluded. I was benevolent and good; misery made me a fiend. Make me happy, and I shall again be virtuous.
Shelley wrote the novel at nineteen. It is usually remembered as a warning against making artificial beings. The creature’s speech says something else: the disaster came from a maker who brought a being into the world and then refused all responsibility for it. In the novel “Frankenstein” is the name of the maker. The creature has none.

Objections and replies
Humans are biased, tired, and cruel. A machine that is merely consistent would be a moral improvement.
In some tasks this is true, and it is the best argument for using machines. Consistency is a virtue only when what is repeated is right. A consistent machine applies one error to a million cases at once, where a thousand inconsistent clerks would have made a thousand different errors, some of which someone would have noticed. The gain has to be shown case by case, with the machine’s mistakes counted as carefully as the humans’.
The trolley cases are fantasies. Engineers should build cars that brake well and leave philosophy alone.
The dramatic cases are rare, and engineers are right to say so. The ordinary ones are everywhere. How close a car passes a cyclist, how much risk it accepts to save its passenger a minute, and whose streets it is tested on are all trade-offs between people’s interests, and each is settled by a number someone typed. Calling the number a technical parameter does not make the choice a technical one.
If machines learn judgment as children do, they will in time become moral agents, and the problem will solve itself.
Perhaps, and it would then raise the opposite problem, the one the creature puts to Frankenstein: what we owe to a being we have made that can be wronged. Until there is reason to think that point has been reached, the practical danger lies in the other direction. People credit a system with judgment because it speaks fluently, and then lean on it. A child is raised for years among people who correct it and care how it turns out. That is a fair standard to ask of anything we propose to trust in the same way.

Dharma and the West ·
A view from the Dharma
The Buddha located the moral quality of an act in a place where present machines have nothing. “It is intention that I call deeds. For after making a choice one acts by way of body, speech, and mind.” On this analysis the same outward movement is a different act according to the intention behind it, and it is intention that bears fruit for the one who acts. A machine that has no intention makes no karma. This agrees with the view reached above that the machine is an instrument. The karma of what it does belongs to those who designed it, sold it, and set it to work, each according to what they intended and what they chose not to look at. The responsibility gap, seen this way, is produced by not looking. Carelessness about results that one could have foreseen is itself a state of mind with consequences.
The lesson’s main finding also has a Buddhist form. The precepts are called training rules. They are undertaken as a discipline for the mind, and the tradition has always held that they need wisdom to be applied. The Mahāyāna speaks of skill in means, the capacity to see what a particular being needs at a particular time, and it treats this as inseparable from compassion. A bodhisattva who had memorized every rule and lacked that capacity would be like the robot in the exercise. The tradition would therefore ask one question about any proposal to hand a decision to a machine. It would ask who is paying attention, and whether the arrangement makes the people involved more attentive to those affected or less.
