What Is Fair?

Everyone wants a fair share and no one agrees on what it is. Aristotle’s proportion, Rawls’s veil of ignorance, Nozick’s basketball player, and a society you must design before you know which place in it will be yours.

The last lesson asked why we need rules at all. This one asks how the rules should divide what a society produces. People who agree that shares should be fair turn out to mean at least four different things, and the choice among them decides who pays for schools and hospitals, and who is owed what.

The essay · 課文

What Is Fair?

01One cuts, the other chooses

The sense of unfairness is older than philosophy and probably older than our species. In a well-known experiment, two capuchin monkeys in neighboring cages were paid for the same small task. Both were content to receive a slice of cucumber until one of them was given a grape. The other then threw her cucumber back at the experimenter. Children of three behave in much the same way. What takes longer to develop is the ability to state a rule that both sides can accept.

Parents know one such rule. Two children are to share a cake, so one cuts and the other chooses. The child with the knife does not know which piece will be hers, and so she cuts as evenly as she can. No one has to trust anyone’s good will. The fairness comes from a procedure in which a person decides before she knows where she will end up. The most influential theory of justice of the last hundred years is that kitchen rule applied to a whole society.

02Equal to what?

Aristotle gave the first careful account. Justice in distribution, he said, is a kind of proportion. Quarrels arise “when either equals have and are awarded unequal shares, or unequals equal shares.” If two people worked on a job and one worked twice as long, equal pay would be unfair. He then identified the real difficulty. Everyone agrees that shares should follow merit, and they do not agree about what merit is. Democrats say it is being a free citizen, oligarchs say wealth, and aristocrats say excellence.

The argument has not changed much since. One side holds that shares should follow contribution, another that they should follow need, and a third that they should simply be equal. Chinese thinkers divided along the same lines. Mencius, arguing against a reformer who wanted goods of the same size sold at the same price whatever their quality, replied that “it is the nature of things to be unequal,” and that to treat them alike would throw the world into confusion. The Daodejing took the other side: the way of Heaven takes from what has too much and gives to what has too little, while the way of men takes from those who have too little to offer to those who have too much.

03Behind the veil

In 1971 the American philosopher John Rawls proposed a way to settle the matter without first agreeing on merit. Imagine that the members of a society meet to choose the principles that will govern it. They know the general facts about economics and human psychology. They do not know anything about themselves: whether they will be rich or poor, clever or slow, healthy or sick, male or female, of which race or which religion. Rawls called this condition the veil of ignorance. Since no one can design rules to favor his own case, whatever is chosen there is fair, for the same reason the cake is fairly cut.

Rawls argued that people in that position would choose two principles. The first gives everyone the same basic liberties, such as freedom of speech and conscience and the vote. The second allows inequalities of wealth and position on two conditions: the positions must be open to all under fair equality of opportunity, and the inequalities must work to the greatest benefit of the least advantaged. He called this last condition the difference principle. A surgeon may earn more than a porter if paying surgeons more makes the porter better off than he would be under any other arrangement. The reasoning is that of someone who may turn out to be the porter.

Behind the veil lies a claim about luck. Nobody chooses his parents, his native talents, or the country and century of his birth. “No one deserves his greater natural capacity,” Rawls wrote, “nor merits a more favorable starting place in society.” If so, the fortunate may keep the fruits of their gifts only on terms that the unlucky could accept.

04Liberty upsets patterns

Three years later Robert Nozick, a younger colleague of Rawls in the Harvard philosophy department, published the best-known reply. Begin, he said, with whatever distribution you think is just. Call it D1. Now suppose that the basketball star Wilt Chamberlain signs a contract under which twenty-five cents from every ticket goes to him. In the course of a season a million people gladly drop their quarters in a box, and Chamberlain ends up with $250,000, far more than anyone else. The new distribution, D2, no longer fits your pattern. Yet everyone began with a just share and moved to D2 by free choices, so it is hard to see what could make D2 unjust.

Nozick concluded that justice depends on how holdings came about and that no particular shape of distribution is required. What a person acquired fairly and received by free exchange or gift is his. To preserve any pattern, a government would have to interfere with people’s choices without end. Hume had made the same point in 1751: “Render possessions ever so equal, men’s different degrees of art, care, and industry will immediately break that equality.” Nozick drew a sharper conclusion than Hume did. Taxing earnings, he wrote, is “on a par with forced labor.”

Rawls’s reply was that his principles govern the basic structure of society, meaning its tax system, its schools, and its law of property and inheritance. They do not govern each transaction. Within fair background rules, people may trade as they like. Without such rules, Chamberlain’s children start the next game with an advantage they did nothing to earn, and their children with a greater one.

05Would you really choose that?

A second objection accepts the veil and disputes what would be chosen behind it. The economist John Harsanyi had used a similar device some years before Rawls, and he drew the opposite conclusion. A rational person who has an equal chance of being anyone would choose the society with the highest average, and that is the utilitarian answer. To insist on the best possible worst case is to reason like someone who never crosses a street. Rawls answered that the stake here is one’s whole life, with no second draw, and that no one could honestly ask the losers to accept their lot for the sake of a higher average.

In the 1980s two political scientists, Norman Frohlich and Joe Oppenheimer, tried the experiment on real people. Groups of students were asked to agree on a rule for dividing income before they knew what their own income would be. Almost none chose Rawls’s difference principle, and few chose the highest average. Most groups, in several countries, settled on a mixed rule: guarantee a floor below which no one may fall, and above it let the total grow as large as it can.

06What the veil is for 這道幕是做什麼用的

None of this has ended the argument. What Rawls gave to both sides is a test for our own opinions. Most views about fairness fit the interests of those who hold them. The well-paid tend to believe in desert, and the badly paid in need. The veil asks one question: would you still favor this rule if you did not know which side of it you would be on? It is the question the child with the knife has to answer. A rule that passes may still be mistaken, but it is not merely self-serving.

In their own words

The oldest statement of what fairness in distribution is, and the classic warning about trying to enforce equal shares. Rawls’s and Nozick’s books are still in copyright and are quoted only briefly in the essay.

Aristotle, Nicomachean Ethics, Book V, chapter 3 (1131a); David Hume, An Enquiry Concerning the Principles of Morals (1751), Section III, Part II 亞里斯多德《尼各馬可倫理學》卷五第三章;休謨《道德原則研究》第三節第二部分 · Aristotle translated by W. D. Ross (public domain); Hume in the original English and spelling

If they are not equal, they will not have what is equal, but this is the origin of quarrels and complaints—when either equals have and are awarded unequal shares, or unequals equal shares. Further, this is plain from the fact that awards should be ‘according to merit’; for all men agree that what is just in distribution must be according to merit in some sense, though they do not all specify the same sort of merit, but democrats identify it with the status of freeman, supporters of oligarchy with wealth (or with noble birth), and supporters of aristocracy with excellence. The just, then, is a species of the proportionate.

Nicomachean Ethics V.3, 1131a

Aristotle is speaking of the distribution of honors and offices in a city as much as of money. His formula is still the one everyone uses: treat like cases alike and different cases differently. The dispute is over which differences count.

Render possessions ever so equal, men’s different degrees of art, care, and industry will immediately break that equality. Or if you check these virtues, you reduce society to the most extreme indigence; and instead of preventing want and beggary in a few, render it unavoidable to the whole community. The most rigorous inquisition too is requisite to watch every inequality on its first appearance; and the most severe jurisdiction, to punish and redress it.

An Enquiry Concerning the Principles of Morals, III.ii

Hume grants a few lines earlier that a rule of equality would be highly useful if it could be kept. His objection is practical. Nozick’s Chamberlain argument is this paragraph turned into a story, with a claim about rights added.

Both sides ·

Objections and replies

Objection 1 · 反駁

People deserve what they earn by hard work. The veil hides exactly the facts that justify unequal rewards.

Reply · 回應

Rawls replied that the capacity for effort is itself shaped by a fortunate family and upbringing, so that desert cannot be the foundation. Many readers find this his least convincing step, since it seems to leave nothing that a person can take credit for. A moderate position is open: effort deserves reward, and the size of the reward that a given effort commands in the market is largely luck.

Objection 2 · 反駁

If taxing earnings is forced labor, as Nozick says, then every modern state is a slave owner. That cannot be right.

Reply · 回應

Critics answer that a worker who is taxed may choose his occupation, his hours, and whether to work at all, which a forced laborer may not. They add that Nozick’s theory requires holdings to have been justly acquired in the first place, and that almost no actual holding has a clean history. Nozick admitted that past injustice might call for large corrections, and he later wrote that the libertarian position he had defended was seriously inadequate.

Objection 3 · 反駁

Fairness is about how we treat one another. A society could satisfy Rawls’s principles and still be full of contempt for those at the bottom.

Reply · 回應

Elizabeth Anderson, who studied under Rawls, pressed this point. The aim of equality, she argued, is that people stand as equals, with no one made to bow. Compensating the unlucky for their bad luck is a different thing. A check that comes with pity may worsen the insult. Rawls would largely agree. He listed the social bases of self-respect among the goods to be distributed, and called it perhaps the most important of them.

Dharma and the West ·

A view from the Dharma

The Buddha gave no theory of distribution, but one discourse reads like a parable about the floor. A king is told the duties of a just ruler, one of which is: “Provide money to the penniless in the realm.” He keeps order and neglects this one duty. Poverty spreads, and a man steals. Brought before the king, he says, “Your Majesty, I can’t survive.” The king gives him money. Others hear of it and steal as well, so the king turns to executions, and people arm themselves. The discourse sums up: “From not providing money to the penniless, poverty became widespread. When poverty was widespread, theft became widespread. When theft was widespread, swords became widespread.” The text does not say that everyone must have the same. It says that a society which lets some fall below what is needed to live will pay for it in violence, and that relief after the theft comes too late.

Within the monastic community the rule was closer to equality. Among the six qualities that hold a community together, the Buddha lists this: a monk “shares without reservation any material things they have gained by legitimate means, even the food placed in the alms-bowl.” Chinese Buddhism calls this 利和同均, harmony in the equal sharing of gains. The Buddha also rejected the oldest criterion of desert in India, which was birth: “You’re not a lowlife by birth, nor by birth are you a brahmin.” On one point, though, the tradition differs sharply from Rawls. For Rawls the circumstances of birth are a lottery and no one deserves his place. On the Buddhist account they are connected with past action. That teaching was never meant to excuse the fortunate. The king’s duty in the story does not depend on how the poor came to be poor (Dharma and Western Philosophy D18, D19).
