Why Are There Two Houses?

Choose a state and see its seats light up in both chambers: many in the House if it is large, always two in the Senate.

Big idea ·

Congress has two chambers built on two different ways of counting the states, because the framers could not agree on one. The House gives seats by population; the Senate gives every state an equal vote. The compromise of 1787 built that disagreement into the government, and every law must now win a majority in both.

Unit 5: Why Are There Two Houses?

In the Congress of the Articles of Confederation, each state's delegation cast one vote, whatever the state's size. When delegates met in Philadelphia in 1787, the large states wanted that rule gone. The Virginia Plan, presented on May 29, proposed a legislature of two branches, with votes in proportion to each state's wealth or free population. On June 15 the New Jersey Plan answered by proposing to strengthen the existing Congress, where each state kept its single vote. For weeks the convention argued over this one question, and several delegates feared it would break up the meeting before a constitution could be written.

The answer, adopted on July 16, 1787, is usually called the Great Compromise or the Connecticut Compromise, after its architects, the Connecticut delegates Roger Sherman and Oliver Ellsworth. One chamber, the House of Representatives, would be apportioned by population. The other, the Senate, would give each state an equal vote; a week later, on July 23, the delegates settled on two senators per state. The vote was five states to four, with Massachusetts divided, and it was taken by state delegations, not by individuals. The large states had won one chamber; the small states had kept equality in the other.

The two chambers were also designed to differ in character. Representatives serve two-year terms, so they must face the voters often. Senators serve six-year terms, and only about a third of the Senate is elected every two years, so the chamber changes slowly. A representative must be at least 25 years old and a citizen for seven years; a senator, at least 30 and a citizen for nine. The framers expected the House to reflect the mood of the people quickly and the Senate to be steadier. Both must pass the same bill, in the same words, before it can become law.

Counting people for the House raised a harder question. The Constitution counted each enslaved person as three fifths of a person when dividing seats, and it excluded “Indians not taxed.” The three-fifths rule gave the slaveholding states more seats in the House, and therefore more electoral votes, than their free population alone would have earned, while the people counted had no vote at all. After the Civil War, the Fourteenth Amendment replaced the rule: seats would be based on “the whole number of persons in each State,” though it still excluded “Indians not taxed.” The original compromise over representation cannot be told honestly without this part.

Senators were not at first chosen by the voters. The Constitution gave that power to the state legislatures, partly so that the states as governments would have a voice in the national government. Over time, deadlocked legislatures left Senate seats empty, and many Americans came to see the system as indirect and open to corruption. The Seventeenth Amendment, ratified in 1913, provided that senators would be “elected by the people” of each state. The equal vote of every state in the Senate did not change, and Article V protects it: no state may lose that equality without its own consent.

The size of the House is set by law, not by the Constitution. The first House had 65 members. It generally grew with the population, though it shrank once, after the 1840 census, until 1911, when Congress set the number at 433, with one seat added for each of the two territories expected to become states. Since 1913 the House has had 435 voting members, except from 1959 to 1963, when it briefly had 437 after Alaska and Hawaii joined the Union. After each census the 435 seats are divided among the states by a formula, and every state receives at least one. After the 2020 census, California had 52 seats, and six states had one each.

The two chambers also hold different powers. Bills for raising revenue must start in the House. The House alone can impeach a federal official, and the Senate alone can try the case, with conviction requiring two thirds of the senators present. The Senate also gives its “advice and consent” to treaties, which need two thirds of the senators present, and to the president's nominations of judges and other officers. Each chamber writes its own rules. For example, under Senate rules, ending debate on most bills takes sixty votes, so more than forty senators can keep a bill that a simple majority supports from coming to a vote.

How the Senate's equal vote should be judged is still argued. Both sides start from the same facts: in 2020 the most populous state had more than 68 times as many residents as the least populous, and each has two senators. Supporters say the design protects smaller states, makes laws win support across many regions, and reflects a union of states as well as of people. Critics say it gives some voters far more weight than others, lets senators representing a minority of Americans block a majority, and applies a rule made for thirteen states to fifty. This lesson presents both arguments without deciding between them.

Questions ·

Why did the large states and the small states each think their own plan was fair?

The large states argued that a government acting on people should count people, so more residents should mean more seats. The small states argued that the states had entered the union as equals and would be outvoted on everything if votes followed population. Each side was applying a different idea of whom Congress represents: individual people or member states.

The framers gave the House two-year terms and the Senate six-year terms. What did they hope each choice would achieve?

Short terms keep representatives close to the voters, who can replace them every two years. Long, staggered terms make the Senate change slowly, so it can resist passing moods and take a longer view. The cost of the first is that members are always campaigning; the cost of the second is that the Senate may respond more slowly to public opinion.

Why can the original compromise over representation not be told honestly without the three-fifths clause?

The compromise decided how to count people for the House, and the three-fifths clause was part of that count. It gave the slaveholding states extra seats and electoral votes based on enslaved people who could not vote. Leaving it out would make the compromise look like a simple bargain between large and small states, when it also settled power between slave and free states.

… He hoped it would become a ground of compromise with regard to the 2d. branch. We were partly national; partly federal. The proportional representation in the first branch was conformable to the national principle & would secure the large States agst. the small. An equality of voices was conformable to the federal principle and was necessary to secure the Small States agst. the large. He trusted that on this middle ground a compromise would take place. He did not see that it could on any other. And if no compromise should take place, our meeting would not only be in vain but worse than in vain.

The diversity of opinions turns on two points. If a proportional representation takes place, the small States contend that their liberties will be in danger. If an equality of votes is to be put in its place, the large States say their money will be in danger. When a broad table is to be made, and the edges of planks do not fit, the artist takes a little from both, and makes a good joint.

Argument for ratification, 1788 · 1788

Publius. The Library of Congress lists the author as Alexander Hamilton or James Madison.

The equality of representation in the Senate is another point, which, being evidently the result of compromise between the opposite pretensions of the large and the small States, does not call for much discussion. … In this spirit it may be remarked, that the equal vote allowed to each State is at once a constitutional recognition of the portion of sovereignty remaining in the individual States, and an instrument for preserving that residuary sovereignty.

In this point of view, a senate, as a second branch of the legislative assembly, distinct from, and dividing the power with, a first, must be in all cases a salutary check on the government. It doubles the security to the people, by requiring the concurrence of two distinct bodies in schemes of usurpation or perfidy, where the ambition or corruption of one would otherwise be sufficient.

Equal votes for states, or equal weight for people?

The House settles representation by population. The argument is about the Senate: should every state have the same voice, however many people live there? Delegates argued it in 1787, and Americans still do. Each side is stated here in its strongest form, and the card does not choose between them.

Should the Senate give every state the same two votes?

One position ·

Keep an equal vote for every state保留每州平等的一票

  • The United States is a union of states as well as of people. An equal vote recognizes that each state keeps part of its own authority.
  • Without it, a handful of populous states could outvote the rest on every question. Laws must instead win support across many states and regions.
  • Two chambers chosen on different principles make every law pass two different majorities, which slows hasty or harmful legislation.
He said as the States would remain possessed of certain individual rights, each State ought to be able to protect itself: otherwise a few large States will rule the rest.Roger Sherman of Connecticut, as recorded in Madison's notes, June 11,

Give every person equal weight

  • Government acts on individuals, not on states. Each person's voice in making the laws should count the same, wherever that person lives.
  • Equal state votes let senators who together represent a minority of Americans block what senators representing a majority want.
  • Population is the rule elsewhere in American government. Since 1964 the Supreme Court has required both chambers of every state legislature to be apportioned by population.
… the majority of States might still injure the majority of people. … they could obstruct the wishes and interests of the majority.James Madison of Virginia, answering the argument that the large states' majority in the House would protect them, as recorded in his notes, June 30, 1787……

Two things to notice. Both systems guarantee a minimum to small units: every American state has at least one representative, and every Taiwanese county and city has at least one legislator. But only the American design adds a second chamber in which every state is equal.

Four things people get wrong

The Constitution says the House has 435 members.

It does not. The Constitution sets only a ceiling of one representative for every thirty thousand people and at least one per state. The number 435 comes from laws passed in 1911 and 1929.

Senators have always been elected by the voters.

Until the Seventeenth Amendment was ratified in 1913, the Constitution gave the choice to the state legislatures.

Larger states have more senators.

Every state has exactly two. Population matters only in the House.

The House and the Senate do the same job twice.

Both must pass every law, but each also has powers the other lacks: the House starts revenue bills and impeaches, and the Senate tries impeachments, approves treaties, and confirms nominees.

Activity 1 ·

Rerun the Convention

You need ·

  • The 1789 House seats from the model (or Article I, Section 2)

Steps · 步驟

  1. Divide the class into state delegations, large and small, using the 1789 seats as a guide to size. (Rhode Island never sent delegates to the convention.)
  2. Each delegation argues for the Virginia Plan or the New Jersey Plan, depending on its interest.
  3. Vote by delegation, one vote per state, as the convention did. Then try to find a compromise that can pass.
  4. Compare your result with the July 16, 1787 compromise.

The point is to feel why one vote per delegation made the small states hard to outvote at the convention itself.

Activity 2 ·

One Seat, How Many People?

You need ·

  • The “How Much Is One Seat Worth?” table above
  • A calculator計算機

Steps · 步驟

  1. Choose five states of different sizes and record residents per representative and per senator.
  2. Make two bar charts, one for each chamber, using the same scale.
  3. Write two sentences: one describing what the charts show, and one stating an argument from either side of the design debate that the charts could support.

Keep the description and the argument separate: the first should be something everyone can agree on.
